Terms of Service

1. Introduction and Acceptance

These Terms of Service ("Terms") govern your access to and use of the Askida platform ("Platform"), operated by IN2050 Ltd, a company registered in the Republic of Cyprus ("we", "us", "Askida").

Askida is a digital platform for anonymous charitable giving. Using existing parcel locker networks, Askida enables individuals to donate items anonymously and recipients to collect them with dignity — without meetings, without names, without obligation.

By creating an account or using the Platform, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.

These Terms constitute a legally binding agreement between you and IN2050 Ltd. They do not create any relationship of agency, partnership, joint venture, or employment between you and Askida.

2. Definitions

"Platform" means the Askida web application, progressive web app, and all associated services accessible at askida.foundation and related domains.

"Donor" means a registered user who posts an item for anonymous donation through the Platform.

"Recipient" means any person who claims and collects an item via the Platform, whether or not they hold a registered account.

"Item" means any physical good listed on the Platform for anonymous donation.

"Claim Code" means the unique, single-use alphanumeric code issued to a Recipient for the purpose of collecting an Item from a parcel locker.

"Locker" means a parcel locker operated by a third-party provider (such as BOX NOW, Skroutz, or ELTA) used for the physical exchange of Items.

3. Platform Description and Role

3.1 What Askida Does

Askida is a facilitator. The Platform provides the digital infrastructure to connect anonymous donors with recipients through existing parcel locker networks. Askida does not own, inspect, store, transport, or handle any Items listed on the Platform.

3.2 What Askida Is Not

Askida is not a commercial marketplace, a sales platform, or a party to any exchange between Donors and Recipients. No consideration (payment, barter, or other value) passes between Donors and Recipients, and no commercial transaction takes place. Accordingly:

  • The EU Consumer Rights Directive (2011/83/EU) and associated distance selling withdrawal rights do not apply to exchanges facilitated through the Platform.
  • Askida makes no warranty, express or implied, regarding the quality, safety, condition, suitability, or fitness for purpose of any Item listed on the Platform.
  • Askida does not act as agent, trustee, or intermediary for either Donors or Recipients.

4. Eligibility

To create an account on the Platform, you must be at least 18 years of age. By registering, you represent and warrant that you are 18 years or older and have the legal capacity to enter into a binding agreement.

If we have reasonable grounds to believe that a user is under 18 years of age, we reserve the right to suspend or terminate their account without notice.

5. Account Registration and Security

To post Items as a Donor, you must create an account by providing a valid email address and, optionally, your name and phone number. You are responsible for:

  • Maintaining the confidentiality of your login credentials.
  • All activity that occurs under your account.
  • Notifying us promptly at hello@askida.foundation if you become aware of any unauthorised use of your account.

Recipients may claim Items without creating an account. A valid email address is required to receive a Claim Code.

6. Donor Obligations

6.1 Item Standards

By listing an Item on the Platform, you represent and warrant that:

  • The Item is clean, safe, legal to possess and transfer, and in the condition described in your listing.
  • The Item is your property, or you have the right to give it away.
  • The listing description and photographs accurately represent the Item.

6.2 Deposit Obligation

Once an Item has been claimed by a Recipient, the Donor must deposit it at the designated Locker within 48 hours of the claim. Failure to deposit within this timeframe may result in the claim being voided and the Item being relisted or removed.

6.3 Prohibited Items

The following Items are strictly prohibited from being listed on the Platform:

  • Weapons, ammunition, or explosives of any kind
  • Prescription or over-the-counter medicines, medical devices, or pharmaceutical products
  • Perishable food items or items requiring refrigeration
  • Hazardous, toxic, flammable, or radioactive materials
  • Counterfeit, pirated, or stolen goods
  • Products subject to manufacturer recalls
  • Tobacco, alcohol, or controlled substances
  • Items containing personal data of third parties
  • Any item whose possession or transfer is prohibited by the laws of the Hellenic Republic or the European Union

Askida reserves the right to reject, remove, or delist any Item at its sole discretion, without obligation to provide reasons.

7. Recipient Obligations

7.1 Collection

Upon receiving a Claim Code, the Recipient must collect the Item from the designated Locker within 48 hours. Failure to collect within this timeframe may result in the Item being returned, relisted, or disposed of at Askida's discretion.

7.2 Claim Codes

Claim Codes are single-use and non-transferable. Each Claim Code is issued to one Recipient for one Item. Sharing, selling, or transferring a Claim Code is prohibited.

If a Recipient shares a Claim Code with a third party, Askida bears no liability for the consequences. The person who presents the Claim Code at the Locker shall be deemed the Recipient for all purposes.

8. Content Moderation

All Items submitted to the Platform are subject to review before being listed publicly. Askida may, at its sole discretion:

  • Approve or reject any Item listing.
  • Request additional information or photographs from the Donor.
  • Remove any listing that violates these Terms, applicable law, or that Askida considers inappropriate.

Askida does not physically inspect Items. Content moderation is based on the information provided by the Donor (descriptions and photographs). Askida cannot guarantee the accuracy, completeness, or truthfulness of any listing.

9. User Content

9.1 Licence Grant

By uploading photographs, descriptions, or other content to the Platform ("User Content"), you grant Askida a non-exclusive, royalty-free, worldwide, sublicensable licence to use, display, reproduce, and distribute your User Content solely for the purpose of operating, promoting, and improving the Platform.

This licence terminates when your User Content is deleted from the Platform, subject to reasonable backup and caching periods.

9.2 Your Warranties

You represent and warrant that you own or have the necessary rights to your User Content and that it does not infringe the intellectual property rights of any third party.

10. Intellectual Property

The Platform, including its design, code, branding, logos, text, and underlying technology, is the intellectual property of IN2050 Ltd and is protected by applicable copyright, trademark, and other intellectual property laws.

Nothing in these Terms grants you any right, title, or interest in the Platform's intellectual property, except the limited right to use the Platform in accordance with these Terms.

11. Limitation of Liability

11.1 General Limitation

To the maximum extent permitted by applicable law, Askida and its directors, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, personal injury, or property damage, arising out of or in connection with your use of the Platform.

11.2 Specific Exclusions

Without limiting the foregoing, Askida shall not be liable for:

  • The quality, safety, legality, or condition of any Item listed, donated, or received through the Platform.
  • Any failure by a Donor to deposit an Item or by a Recipient to collect an Item.
  • Any action or inaction of third-party Locker providers.
  • Any unauthorised access to or use of your account resulting from your failure to maintain the confidentiality of your credentials.

11.3 Unlimited Liability

Nothing in these Terms shall exclude or limit Askida's liability for: (a) death or personal injury caused by negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be excluded or limited under applicable law.

12. Indemnification

You agree to indemnify and hold harmless IN2050 Ltd and its directors, officers, employees, and agents from and against any claims, damages, losses, and expenses (including reasonable legal fees) arising from: (a) your use of the Platform; (b) your breach of these Terms; (c) your violation of any applicable law; or (d) any Item you list on the Platform.

13. Force Majeure

Askida shall not be liable for any failure or delay in performing its obligations under these Terms if such failure or delay results from circumstances beyond its reasonable control, including but not limited to: natural disasters; acts of government or regulatory authorities; epidemics or pandemics; power outages; internet or telecommunications failures; strikes or labour disputes; failure or disruption of third-party parcel locker networks; cyberattacks; or acts of war or terrorism.

14. Account Suspension and Termination

14.1 Termination by You

You may delete your account at any time by contacting us at hello@askida.foundation or through the account settings (when available). Upon deletion, your personal data will be handled in accordance with our Privacy Policy.

14.2 Termination by Askida

Askida may suspend or terminate your account, at its sole discretion, if:

  • You breach any provision of these Terms.
  • You repeatedly fail to deposit Items after they have been claimed (no-show behaviour).
  • You post prohibited Items or engage in fraudulent activity.
  • Your behaviour is abusive, threatening, or harmful to other users or to the Platform.
  • Askida is required to do so by law or regulatory authority.

14.3 Effect of Termination

Upon termination: (a) your right to access the Platform ceases immediately; (b) any pending Item listings will be cancelled; (c) your personal data will be retained or deleted in accordance with the retention periods set out in our Privacy Policy.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Cyprus, without regard to its conflict of law provisions.

16. Dispute Resolution

16.1 Informal Resolution

In the event of any dispute arising out of or in connection with these Terms, the parties shall first attempt to resolve the dispute through good faith negotiation for a period of thirty (30) days from the date of written notice of the dispute.

16.2 Jurisdiction

If the dispute cannot be resolved through negotiation, it shall be submitted to the exclusive jurisdiction of the courts of Nicosia, Republic of Cyprus.

16.3 EU Online Dispute Resolution

If you are a consumer residing in the European Union, you may also submit a complaint through the EU Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr. However, as Askida is a free, non-commercial service, the ODR platform may not apply. We include this reference for transparency.

17. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify registered users by email at least fourteen (14) days before the changes take effect. The updated Terms will also be posted on the Platform with the revised "Last updated" date.

Your continued use of the Platform after the effective date of any changes constitutes your acceptance of the revised Terms.

18. Severability

If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions shall continue in full force and effect.

19. Entire Agreement

These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and Askida regarding your use of the Platform and supersede all prior agreements, understandings, and communications.
